Terms & Conditions

I think complete transparency is the best way to run a business so here is a little list of things that you may want to read through before you book me! If you have any questions regarding any of the points raised below I would be happy to answer them.

Booking & payment

Your wedding date will be marked in pencil in my calendar for a period of 2 weeks following your initial enquiry. Should anyone else contact me about the same date during that period I will contact you out of courtesy before replying to the other couple. If I don't hear from you within 2 days I will assume you are no longer interested and release the date to the other couple.

Your wedding date will be held for a period of 2 weeks after the booking proposal and contract have been sent out. Your wedding date will only be confirmed upon receipt of the 20% booking fee required upon signing the contract.

The balance (80%) is due no later than 4 weeks before the wedding date. 

Failure to pay in full by this agreed date will make the contract void.

If you cancel later than 14 days after the date the booking fee was paid the following percentage fees apply against the full cost:

90 days or less - 100% of the amount owed is to be paid

91 - 130 days - 75%

131 - 180 days - 50%

Should you wish to change the wedding date all monies can be transferred to a new date subject to my availability. Please note this may incur extra charges if the date is on a prime weekend/bank holiday.

Should I have to cancel for reasons beyond my control (e.g: death, injury or sickness) liability shall be limited to the amount of monies paid. If I have to cancel within two weeks of the wedding date a full refund will be paid OR an alternative photographer will be sourced. The replacement photographer will be of the same or higher qualification, style and pricing. 

Additional fees

Unless you have upgraded to the 'Epic Engagement Session', the location of your Engagement session will be within Essex or Suffolk. If you wish to have your session further away I will need my travel expenses covered. Travel expenses can include tolls, parking charges, mileage (calculated at £0.35 per mile), train and tube fares.

For UK Weddings, if the location of the ceremony and/or reception is over 2 hours away from Colchester, I will require my travel expenses and 1 night accomodation to be covered. Travel expenses can include tolls, parking charges, mileage (calculated at £0.35 per mile), train and tube fares.

 

This will be discussed during our initial consultation.

For Weddings in Europe, I will require my travel expenses and 2 nights accomodation to be covered. The travel expenses will include airport parking, hold luggage (so I can bring clothes because my hand luggage will be full of camera stuff!) airport transfers and/or a hire car.

For Weddings in outside Europe, I will require my travel expenses and 5 nights accomodation to be covered. The travel expenses will include airport parking, hold luggage (so I can bring clothes because my hand luggage will be full of camera stuff!) airport transfers and/or a hire car.

Wedding day

Once you have worked out a timeline and itinerary for the wedding day, please send me a copy so I can plan ahead!

It's always a bit tricky for photographers to get food as usually venues are miles away from any shops and keeping a sandwich in the car for 8 hours isn't really an option so it would be greatly appreciated if me and my second photographer (if applicable) could be fed! Doesn't have to be a 3 course meal with champagne and all of course.

PS: I'm a vegetarian, hope that's okay 🙂

Depending on the length of the wedding day I will take up to 1.5 hours of breaks, usually after the ceremony and during the wedding breakfast.

In the (hopefully very) unlikely event that something happens to me and/or my second photographer on our way to the wedding, fret not, I have an emergency plan which I will send you before the wedding!

Work to be carried out

The photographer(s) will record the day in a documentary style.

Any photographs required other than that of a documentary nature will need to be expressly requested prior to or on the wedding day.

I will endeavour to capture these photographs, however please note that on occasion circumstances out of my control may occur meaning I will not be able to capture these photographs - for example, weather and schedule.

Please note I cannot and will not photograph every single person at your wedding. If there are special people you would like me to photograph please let me know and point them out to me!

During the editing process I use Presets which apply pre-determined settings to all the photographs such as brightness, saturation etc... I then go through each and every photograph and tweak the Preset applied depending on the lighting and content of the photograph. 

These Presets were designed and perfected by myself over the years and represent my photography style. By booking me you accept that these Presets will be used.

During the editing process, I edit out any noticeable blemishes and/or small distractions (for instance litter on the ground). 

I will carry out a more in depth 'photoshopping' on any image you select for wall art printing, whether included in your package or purchased as an add on, if required. This will be limited to removing blemishes, smoothing skin and removing larger distractions where possible (for instance cars in the background).

If you wish for me to carry out more complex 'photoshopping' please let me know and I will send you a quote based on the complexity of the work and the number of images required.

I cannot guarantee the number photographs supplied as this will depend on a variety of factors including the number of guests, length of your day, how many photographers were booked etc... 

As a rough guide for a full day wedding I deliver between 300 and 500 photographs, or 500 and 700 when two photographers are booked.

Please be aware that all usable photographs are delivered. Duplicates, blinkers or blurs are deleted during the culling process.

I do not deliver unedited (RAW) photographs. 

A sneak peek gallery will be delivered within 48hrs of you wedding.

The full gallery will be delivered within 2-4 weeks.

Image & Data storage

Following GDPR regulations, you have the right to know where your personal information and photographs are stored, for how long and what happens to them after they are transferred to you.

All personal information provided from the date of the initial enquiry until delivery of the photographs is stored on my online Sprout Studio account (password protected).

This information will be stored and used as per my privacy policy.

Photographs are captured on up to four cameras with dual slots (two SD memory cards per camera). 

The unedited (RAW) photographs are backed up on an external hard drive as well as on my online Dropbox account (password protected). All SD cards will be cleared after the unedited (RAW) photographs have been backed up. Unedited (RAW) photographs will be deleted from my hard drive and Dropbox account 3 calendar months after the date of your wedding.

 

Once edited, your photographs are uploaded onto your Sprout Studio gallery where you can view and download them. 

 

 

The edited photographs will be stored on your Sprout Studio gallery for 2 year before the gallery is archived. If you require access to your gallery after it as been archived please get in touch and I will re activate it for you and let you know of the new expiry date. Another copy of the edited photographs will be stored on my online Dropbox account for 10 years.

 

Please note I cannot guarantee that your gallery will be available at all times during the 2 year period. Should you encounter any issues please let me know and I will contact Sprout Studio to attempt to resolve the issues. Should Sprout Studio fail to resolve the issues or cease to trade altogether I will find an alternative provider for your gallery.

Image usage

Following GDPR regulations, you have the right to know where your photographs get used and how they get used. You will be given the choice to opt in or out of the 'model release' clause on my contract with respect to identifiable photographs. Should you choose to opt out you will be required to indicate which uses (if any) you agree to (social media, printed materials, website, competition).

Unless you have opted out of social media usage on the contract, I reserve the right to share photographs of your wedding on social media during the wedding.

 

I also reserve the right to share photographs of details/venues (anything except identifiable photographs) on social media during the wedding.

Unless you have opted out of the model release on the contract, I reserve the right to share photographs of your wedding on social media, use them on my website, blog, in printed materials and enter them in competitions after the wedding.

It is your responsibility and/or the responsibility of your guests to inform the photographers prior to or during the wedding of any circumstances in which a person cannot have their photograph taken or used.

Miscellaneous

Lucie Mlt Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. My judgment on photographic style and the number of photographs taken shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects Lucie Mlt Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. Only images that meet Lucie Mlt Photography's high creative standards will be provided. Images not supplied to the client are deleted from the systems at point of selection and are not stored in archive.

I will be the sole professional photographer on the day (along with my assigned second shooter where applicable) however friends and family are encouraged to take lots of photographs. Videographers are welcome.

My entire liability in respect of this contract shall be limited to damages of an equal amount to the total price paid by the customer. Neither party shall be liable for any breach of its obligations resulting for causes beyond its reasonable control, which may include acts of god, fire, natural disaster, war and weather. Under the Consumer Rights Act, which superseded the Supply of Goods and Services Act on 1 October 2015, your photographs will be supplied with reasonable care and skill.

If you have any issues with your images upon delivery you must inform me within one calendar month from the date received.
